How to File a Motion for Extension of Time
Missing a court deadline can end your case before a judge ever considers the merits. A motion for extension of time asks the court for more time to complete a required step — filing a response, answering discovery, or serving a document.
When to file
File before the deadline passes whenever possible. A motion filed after the deadline generally has to show excusable neglect, which is a much harder standard than simply showing good cause.
What the motion must contain
- The specific deadline you are asking to extend, and the current date it falls on.
- The concrete obstacle preventing you from meeting it — illness, a records request still outstanding, a scheduling conflict.
- The exact new date you are requesting.
- Whether the opposing party agrees (an unopposed motion is far more likely to be granted).
Courts respond to specifics. "I need more time" is weak. "The hospital records I requested on June 3 have not yet been produced" is strong.
After you file
Do not assume the extension is granted. Until the judge signs an order, the original deadline controls. Keep working toward the original date while the motion is pending.
